Now pending before the Ninth Circuit is a landmark case that could impact the First Amendment rights of manufacturers and retailers.
On October 21, 2011, 118 members of the Basel Convention reached an agreement to unblock the Ban Amendment, an amendment to the Basel Convention that will ban the export of hazardous waste from countries belonging to the Organisation for Economic Cooperation and Development (OECD) to non-OECD countries.
At the end of October, the Consumer Product Safety Commission (CPSC) announced that it had reached a settlement with Spin Master Ltd. based on Spin Master's 2007 recall of "Aqua Dots" due to their toxic nature.
While prospects for amendments to the Toxic Substances Control Act (TSCA) in 2012 remain dim, Chairman Frank Lautenberg (D-NJ) announced at a November 17 hearing of the Senate Environment and Public Works Committee that he intends to move soon for committee action on S. 847, the "Safe Chemicals Act."
The California Department of Toxic Substances Control (DTSC) released a draft revised version of its prior "Green Chemistry" proposal -- now called the Safer Consumer Products rule -- on October 31. If adopted, the rule could have significant impacts on product manufacturers and, eventually, sales.
